Conjugal partners are in relationships (either of the opposite sex or same-sex) where in exceptional circumstances beyond their control they have not been able to marry or live together in a common-law union, for example the foreign partner is married in a country where divorce does not exist, his or her country of residence does not allow marriage of the same sex, or they are kept apart for other reasons related to religion, politics, social or cultural impediments etc..

There are several programs that can lead to permanent residence. IRCC and several provinces have programs that allow applicants to obtain permanent residence. Almost 350, 000 applicants become permanent residents each year from programs such as the Federal Skilled Trades, Federal skilled worker, Provincial Nominee programs, Atlantic Immigration Pilot Program etc.

If you are a recent grad and you have at least one year experience in a qualifying field, you may be eligible to apply to an economic program via the express entry system or one of the provincial nominee programs.

If you are thinking of coming to Canada as a student, Desir Immigration  will provide support with everything you need to secure a student visa. in order for students to secure a work permit, they must have admission into a Designated Learning Institution. After obtaining the student visa you will be allowed to work part time up to 20 hours per week. Temporary Residence Visas

Labour Market Impact Assessment (LMIA)

When Canadian companies need workers who possess certain skill sets and a Canadian or Permanent Resident is not able to fill the position, they have the option of hiring temporary workers by applying for a Labour Market Impact Assessment (LMIA), which was originally called the Labour Market Opinion (LMO). An LMIA is issued by the Employment and Social Development Canada (ESDC).

Canadian companies can get this approval to hire foreign workers after receiving a positive LMIA. The LMIA report lays out the conditions of the employer’s job offer. The LMIA must include the employees’ names and other important details.

Work Permit Renewals

Foriegn workers whose work permits are close to expiring or have expired would need to submit a work permit renewal application. Desir Immigration prepares and submits your work permit visa applications and work permit extensions in a timely manner to ensure that your status is maintained or reinstated.

Obtaining an LMIA is now more difficult than ever before; the employer must meet certain financial and ethical criteria; thereafter, several steps need to be taken over a period of time, then important documentation must be submitted together with the LMIA application.

Permanent Residence for Caregivers

Previously IRCC had a live-in caregiver program available for caregivers. Live-in caregiver program was discontinued from June 18, 2019. Thereafter, the two pilot programs - Home Child Care Provider or Home Support Worker began, and will be available till June 2024.

The great news about these two programs is that there is no LMIA required and once the requirements have been met, the workers can then be eligible for permanent residence.

Home Child Care Provider and Home Support Worker Pilots

As of June 18th, 2019, Caregivers and Home support workers who intend to work in Canada have two options to available to them: Home Child Care Provider Pilot and Home Support Worker Pilot programs. These are Occupation restricted opportunities meaning the worker will be required to work as a Home Child Care Provider or Home Support Worker but he or she can change employers if they wish.

This protects the worker as previous programs did not allow for employer switching, so if a worker was in an abusive situation they would not have had the opportunity to switch employers.

Home Child Care Provider and Home Support Worker Pilots

The Home Child Care Provider applicant would need to have at least a one year Canadian Child Care related post secondry certification or international equivalent which would have to be assessed by an approved institution to have an Education Credential Assessment (ECA) granted.

As well, this individual will have to complete at least two years of Canadian work experience in the field.

The same aforementioned requirements are also needed for Home Support Workers, as they would need education and would need to complete experience in this field.

Visitor Permits and Visas

In order to visit Canada, residents of some countries must first obtain a visitors visa before they travel. There are two types of visitor visas issued by Canadian Government:

There is the Single-entry Visa which allows foreign nationals to enter Canada only once. There is usually a one month expiration after the date of arrival in Canada, but this may be extended up to a maximum of 6 months after entering Canada.

The second is a Multiple-entry Visa which is issued by Canadian Government with a maximum validity date of up to 10 years as this is time period is reflective of the validity of the passport.

Visitor Permits and Visas

Multiple-entry Visa is a  type of visitors visa that is most commonly applied for and the recipient is allowed to enter the country as many times as necessary at the discretion of the Canadian border officials.

There is an alternative to a visitors visa that people with connecting flights can apply for, this is the transit visa. The transit visa is given to travelers for a period less than 48 hours, and it is only issued once you land in Canada.

Visitors visa applications need an invitation letter. The letter must several crucial details. It is not necessary to notarize the letter as this has no weight on the final decision.
